ACCEPTANCE OF TERMS: Bidders who place their first bid whether online or live agree to the terms and conditions of the auction.

BIDDING PROCEDURE:  Each lot will be offered individually. Auctioneer may group multiple lots together as a single lot or offer choice and privilege to the high bidder from the animals within the grouped lot.

PAYMENT TERMS: All accounts shall be settled with Auctioneers prior to removing animals from the sale location. Auctioneer will accept all payments in U.S. Dollars and such may be tendered by cash, check with immediately available funds or credit/debit card. Customers paying with Visa, Mastercard, American Express, Discover or other acceptable electronic payment agree to pay an additional 3.9% service fee to offset the Auctioneer’s cost for processing such payment. All checks shall be made out to Stock Show Auctions.

NON PAYMENT: Any account NOT settled by one (1) hour after the last lot is called sold by the Auctioneer will be assessed an additional 10% late fee and $50 per calendar day thereafter. After seven (7) calendar days, Auctioneers will file criminal charges with the appropriate authorities for theft of livestock to secure payment of the account.

POSSESSION: Possession shall be delivered to buyer on receipt of good funds by Auctioneer. 

INSPECTION: Bidders are encouraged to inspect or preview the offering at the sale location prior to the auction. Auctioneers may host an online preview and video broadcast of the auction. Auctioneers and consignors will provide opinions of the offering but that opinion may or may not prove the same as the potential buyer’s opinion. Therefore, Auctioneer and consignors encourage bidders to personally inspect the animals in person if at all possible. Venue, Host, Consignors and Auctioneer disclaim any and all responsibility for the safety of prospective bidders and other persons during any physical inspection, during the auction or following the auction. Prospective bidders are responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries and due diligence concerning animals being offered for sale. The information contained in marketing materials is subject to verification by all parties relying on it. Sellers, Host, Venue and Auctioneer assume no liability for any inaccuracies, errors or omissions in such materials. 

GUARANTEE: Consignors, Host, Venue nor Auctioneer guarantee the soundness, health or success of any animal in the auction. Any guarantees offered from consignors are not binding upon the Auctioneer, Host or Venue and those disputes shall be settled only between the parties involved. 

AGENCY: StockShowAuctions.com and their respective agents, representatives and contractors are exclusively the agents of the Seller(s). Auctioneer Brent R. Graves, Texas License #13507 is also exclusive agent to seller. 

CONDUCT OF AUCTION: The conduct of the auction and increments of bidding will be at the direction and discretion of the auctioneer. Seller and Auction Company reserve the right to preclude any person from bidding if there is any question as to the person’s identity, credentials, fitness, etc. All decisions of the auctioneer at the auction are final.  

NO GUARANTEE OF INTERNET SERVICE: Venue, Consignors, Host and Auctioneer will prepare internet service at the auction site for the singular use of the Auctioneer and his platform. Auctioneer will conduct the auction in such a manner as to include all potential bidders both live and online. Should the Auctioneer's internet service fail at the auction site, for whatever reason, all Consignors, Bidders and Host hold Auctioneer harmless from any liability from continuing the live auction without internet service. Online bidders accept the risk associated with technology not functioning properly. Auctioneer, Host, Venue and Consignors shall not be held liable or in breach of the terms and conditions of the auction in the event internet service cannot be established between auction platform and bidders. 

LAW, RULES AND VENUE: Auctioneer will conduct the auction in such a manner that is in compliance with the Texas Department of Licensing and Regulation, Texas Animal Health Commission, United States Department of Agriculture, Texas Department of Agriculture and the rules and regulations of each as well as the laws of the State of Texas. Should a dispute arise between bidders (buyers) and sellers, each party agrees to abide by the final decision of the Auctioneer. Should one party feel that a dispute can only be settled through litigation, the agreed venue of such shall be Erath County, Texas.

Licensure by the department does not imply endorsement or approval by the State of Texas.

BOND: Brent R. Graves as StockShowAuctions.com also operates in compliance with Texas Agriculture Code, Chapter 147 holding a Livestock Auction Commission Merchant bond on file with the Honorable Brandon Huckabee, Erath County Judge. Bond is displayed at the principle offices as well as the bond number is displayed on the StockShowAuctions.com website.

CHANGES: Please arrive prior to scheduled auction time to inspect any changes or additions to the information. OFFICIAL ANNOUNCEMENTS MADE FROM THE AUCTION PODIUM ON AUCTION DAY WILL TAKE PRECEDENCE OVER THE MARKETING MATERIALS AND ANY OTHER PRIOR STATEMENTS. IN THE EVENT OF DISPUTE BUYERS AND SELLERS AGREE TO ABIDE BY AUCTIONEER’S DECISION DURING AUCTION AND THROUGHOUT THE AUCTION.

When it comes to loading out animals, we have a few important procedures in place:

First, please hold off on loading your animals until the auctioneer announces the very last one as "SOLD." We appreciate your patience during this time.

If you're a successful buyer or representing one, make sure to have your paid receipt with you when you're ready to move your animal from the barn or pen area. It's an important part of our organization process.

Our staff will also be checking each animal to ensure it matches the buyer's receipt before it's loaded onto a trailer. This step helps prevent any mix-ups and ensures a smooth process.

For online buyers, there's flexibility. You can arrange for animal care through the Auctioneer, Host, or others on Saturday and come by on Sunday for the load-out.

If you need copies of the Certificate of Veterinary Inspection (CVI) for transportation, we'll have those available for buyers.
